The following Terms and Conditions govern all use of the etnmultimedia.com website and all content, services and products available at or through the website. Use of ETN Multimedia services constitutes acceptance and agreement to the Terms and Conditions below.
All content, services and products available via this website and through any other means are owned and operated by Alphonse Tan trading as “ETN Multimedia”.
All transactions made with ETN Multimedia via this website and through any other means are in either in Philippine Currency or in US dollars.
Account Activation
By activating your account with ETN Multimedia, you agree to these Terms and Conditions. Upon requesting activation of an account, you are required to accept these policies, guidelines and disclaimer, and a copy of your acceptance is forwarded along with your activation request to be maintained with your account information.
If you signup for an account and fail to comply with these terms, no refunds will be given. We will, however, advise you by email or phone prior to taking any action to provide you with an opportunity to correct the problem.
Service availability
ETN Multimedia shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from ETN Multimedia’s services going offline or being unavailable for any reason whatsoever. Furthermore, ETN Multimedia shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of ETN Multimedia’s services. All damages shall be limited to the immediate termination of service.
Liability and indemnity
You agree to indemnify and hold harmless ETN Multimedia, its contractors, and its licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of ETN Multimedia services, including but not limited to your violation of this Agreement.
Payments and Billing
On the account creation date and on that day each year following, ETN Multimedia will debit or charge your nominated account/credit card for the amount agreed to during the signup/sales process.
ETN Multimedia uses paypal for all payment processing.
All transmission of payment information takes place within an encrypted SSL tunnel.
If you choose to cancel your account, please note that we do not refund partial months. As of the day you cancel we will schedule the cancellation to take place on the following payment anniversary.
Late Payments
It is the client’s responsibility to ensure that they have sufficient credit to cover this transaction. In the event that there is insufficient credit, we will send an email notification, at which point we will need to be provided with another account number or credit card. You will then be given a ten (10) day grace period. If payment is not made within the ten (10) day grace period, ETN Multimedia reserves the right to suspend your Service(s) with ETN Multimedia and to charge a $10 “late payment fee”. Thirty (30) days following suspension of Services for non-payment, ETN Multimedia reserves the right to terminate Service(s) for non-payment.
ETN Multimedia is not responsible for any damages or losses as a result of suspension or termination for non-payment of your account. In addition, ETN Multimedia reserves the right to refuse to re-activate your Services until any and all outstanding invoice(s) have been paid in full.
Delivery
All relevant details for your new hosting, domain name and back-end access are emailed to the address you registered with. You will receive these emails immediately once your plan has been paid for. You can also find your login details in your ETN Multimedia client area.
If you never receive your welcome email, please check your spam and junk folders. This is the most common complaint and in 99.9% of cases, the missing emails are located in your junk/spam folder. If it is not there, make sure to whitelist @etnmultimedia.com before requesting it again. If you need your welcome email resent, please submit a support ticket or contact us. You can also view all emails we send to you from your client area.
Cancellations and Refunds
ETN Multimedia reserves the right to cancel, suspend, or otherwise restrict access to the account at any time with or without notice. Any abuse of our staff in any medium or format will result in the suspension or termination of your services.
Customers may cancel at any time. ETN Multimedia gives you an unconditional 30 day money back guarantee on all hosting plans. Cancellations requested after the initial 30 days will go into effect within 24hrs of the request. The monthly hosting fee for that month will not be refunded.
For design work, a refund may be requested if a project has not initiated or if the initial design style is not approved.
If we fail to deliver as per our delivery policy after the initial design style is approved, then we will issue a partial refund as per the proportion of the work completed.
If we have completed the project, you have agreed to it and it has been and uploaded onto the server, no refunds will be issued.
There are no refunds for domain name purchases, these however may be transferred into your name and you may transfer them to any other registrar.
Acceptable Use
All services provided by ETN Multimedia may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any Philippine or International law is prohibited. We reserve the right to refuse sites promoting things that violate the laws of other countries as well.
Note: Pornography, paedophilia materials, sex related merchandising hate, hate groups, terror and terrorism groups, drugs and drug related merchandising are prohibited on any ETN Multimedia services. This includes sites that may imply sexual content, or link to adult content elsewhere. This is also true for sites that promote any illegal activity or content that may be damaging to ETN Multimedia services or any other service on the Internet. Links to such materials are also prohibited.
Examples of prohibited content or links include (but are not limited to): Pirated software, hacking programs or archives, Warez sites, distribution of music files or any other material in which the account holder does not own the copyright, porn spamming software, adult sites and game servers. ETN Multimedia will be the sole arbiter as to what constitutes a violation of this provision. Content that does not meet these standards will be removed without prior notice to the customer.
